So, uhm, yeah. Explain to me how this car failed its emissions test last Thursday .... I don't get it.

Easy. Emissions tests are finicky things. They also depend on things like temperature of the shop, for example. It's completely possible for the same car, with no changes, to fail some times and pass other times.
